1. Provided “As Is”
All software products, services, and materials made available by TecDiamond Inc. (“TecDiamond”, “we”, “our”) — including but not limited to Mail Diamond and any other product listed on tecdiamond.com — are provided “as is” and “as available”, with all faults and defects, without warranty of any kind.
2. No Warranties
To the maximum extent permitted by applicable law, TecDiamond expressly disclaims all warranties, express or implied, including but not limited to:
- Warranties of merchantability, fitness for a particular purpose, and non-infringement;
- Warranties that the software will be uninterrupted, timely, secure, or error-free;
- Warranties that data will be preserved, backed up, or secure from loss or corruption;
- Warranties regarding the deliverability of email or the outcome of any marketing campaign.
3. Limitation of Liability
In no event shall TecDiamond, its directors, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, lost data, loss of goodwill, or business interruption — arising out of or related to your use of, or inability to use, our software, even if advised of the possibility of such damages. Email delivery results depend on third-party providers, recipient servers, and sender reputation, all of which are outside our control.
4. Your Responsibility
You are solely responsible for: (a) maintaining backups of your data; (b) complying with anti-spam and privacy laws (including CASL in Canada and CAN-SPAM in the United States) when sending campaigns; (c) the content of messages you send; and (d) maintaining the security of your credentials and devices.
5. Third-Party Services
Our software may interact with third-party email and hosting providers. We are not responsible for the acts, omissions, outages, or policies of any third-party provider.
